Notice on Inspection & Quarantine Requirements of Imported Dairy

The Regulations of the People's Republic of China on the Registration and Administration of Overseas Manufacturers of Imported Food (Order No. 248 of the GACC) and the Measures of the People's Republic of China for the Administration of Import and Export Food Safety (Order No. 249 of the GACC) will officially come into effect on January 1, 2022. The Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Dairy Products will be repealed at the same time. The following related requirements for the inspection and quarantine of imported dairy products will continue to be effective. The announcement is as follows:

I. Imported dairy product shall be accompanied by a health certificate issued by the competent authority of the exporting country or region. The certificate shall have the seal of the competent authority of the exporting country or region and the signature of its authorized person, and the destination shall be marked as the People's Republic of China. The sample of the health certificate shall be confirmed by the GACC.

II. Imported raw milk, raw milk products, pasteurized milk, and modified milk produced and processed by pasteurization need to handle entry quarantine approval.

III. Overseas manufacturers shall be familiar with and ensure that the dairy products exported to China comply with China's national food safety standards and related requirements.

1. For dairy products imported for the first time, the test reports for items listed in the corresponding national food safety standards shall be provided. "First-time import" refers to the import of dairy products with identical information such as overseas manufacturers, product names, formulas, overseas exporters and domestic importers from the same port for the first time.

2. For dairy products that are not imported for the first time, a copy of the test report for first-time import and the test report for the items required by the GACC shall be provided. The items of the test report for non-first-time import are determined by the GACC based on dairy products risk monitoring and other related conditions and published on the website of the GACC (which can be queried in the "Information Service - Inspection and Quarantine Requirements" column on the website of Import and Export Food Safety Bureau of GACC http://jckspj.customs.gov.cn).

3. The production date or production batch number in the test report shall correspond to that of imported dairy products.

4. Implement a notification and commitment system for certification items on the test report of imported dairy products.

IV. The test agency that issues test report for imported dairy products can be an overseas official laboratory, a third-party test agency or a corporate laboratory, or a domestic test agency that has obtained the certification of a food inspection agency.

V. The dairy products referred to in the Announcement include colostrum, raw milk and dairy products. Colostrum refers to milk secreted by dairy animals within 7 days after parturition. Raw milk refers to regular milk without any change in composition that is squeezed from the udders of healthy dairy animals that meet the related requirements of China. Colostrum of dairy animals, milk during antibiotic application and drug withdrawal period, and spoiled milk shall not be regarded as raw milk. Raw dairy products refer to products that are processed from raw milk without heat treatment and sterilization in process. Dairy products refer to foods processed from milk as the main raw material, such as pasteurized milk, sterilized milk, modified milk, fermented milk, cheese and processed cheese, cream, butter, anhydrous milkfat, condensed milk, milk powder, whey powder and whey protein powder, milk-based infant and young children formulas and their production raw material base powder, casein and other milk and milk products (such as milk minerals and milk protein).

The Announcement will be implemented from January 1, 2022. The Announcement on Implementing the Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Dairy Products issued on April 15, 2013 (Announcement No. 53 [2013] of the former AQSIQ), and the Announcement on Adjusting the Implementation Requirements of the Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Dairy Products (Announcement No. 3 [2015] of the former AQSIQ) issued on January 8, 2015 will be repealed at the same time.
