Import of IF and Process(ed) Cheese under Inspection Rules of GB

On March 18, 2021, the NHC issued GB 10765-2021 National Food Safety Standards Infant Formula, GB 10766-2021 National Food Safety Standards Older Infants Formula and GB 10767-2021 National Food Safety Standards Young Children Formula. The details are as follows: New Standards of Infants Formula Landing. On July 28, 2022, NHC together with SAMR issued GB 25192-2022 National Food Safety Standard Process(ed) Cheese and Cheese Products and GB 13102-2022 National Food Safety Standard Concentrated Dairy Products. The details are as follows: New GBs were Issued such as Process(ed) Cheese & Cheese Products.

In order to implement the Food Safety Law of the People's Republic of China, further optimize the business environment and promote the steady development of foreign trade, after consultation with the the National Health Commission and the State Administration for Market Regulation, with reference to international practices and domestic regulatory requirements, hereby announce the import enforcement standards of the above products as follows:

1. Since the implementation of the new national standards, overseas enterprises shall produce foods exported to China according to the new national standards. Products manufactured and imported before the implementation date of the new national standards that comply with the provisions of the old national standards may continue to be imported and sold during their shelf life in accordance with the provisions of the implementation of the domestic standards and the rules of the World Trade Organization. If there are special provisions, the special provisions shall prevail.

2. In order to make good connection between the old and new standards, the consignee or his customs declaration agent of imported goods in China must fill in the "production date" when applying to the Customs the above products actually entered into China. The production date shall be consistent with the production date on the commodity label, and the specific date shall be filled in with 8 digits in the order of year (4 digits), month (2 digits) and day (2 digits).

The above requirements shall be implemented from the implementation date of each new national standard.
